NexeraHive provides an AI-powered operating system for e-commerce teams. The Service includes, but is not limited to: AI-generated product imagery, brand memory and creative workflows, chat-based assistance for e-commerce tasks, and tools for catalog creation and personalization. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or breach of security.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Generate content that infringes intellectual property rights, or that is defamatory, harmful, or otherwise objectionable
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Share account access with unauthorized parties or exceed permitted usage
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to train competing AI models or for similar commercial exploitation

We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

5. Intellectual Property

Your content: You retain ownership of content you upload (e.g., brand assets, product images) and prompts you submit. You grant us a limited license to use, process, and store such content solely to provide and improve the Service.

Generated content: Subject to your compliance with these Terms, you retain ownership of images and copy generated through the Service using your brand assets and prompts. We do not claim ownership of your outputs.

Our property: The Service, including its design, software, and branding, is owned by NexeraHive and protected by intellectual property laws. You may not copy, modify, or create derivative works without our prior written consent.

6. Credits and Billing

The Service operates on a credit-based system. Credits are consumed when you generate content or use certain features. Unused credits do not expire unless otherwise stated. Pricing and credit allocation may change with notice. Refunds are handled on a case-by-case basis in accordance with our policies.

7. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to such collection and use. Your brand assets, generated content, and account information are retained as described in the Privacy Policy unless you request deletion.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED OUTPUTS MAY CONTAIN INACCURACIES OR UNEXPECTED RESULTS; YOU ARE RESPONSIBLE FOR REVIEWING AND VERIFYING ALL CONTENT BEFORE USE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXERAHIVE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless NexeraHive and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
